Acceptable Use Policy

The following activities that harm or interfere with network operations are prohibited:

  • Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks
  • Port scanning or network probing without authorization
  • Packet sniffing or monitoring network traffic of others
  • Circumventing authentication or security measures
  • Bandwidth flooding or network congestion attacks
  • Operating open proxies or relay servers without authorization

2.3 Email and Messaging Abuse

  • Sending unsolicited bulk email (spam)
  • Email bombing or mail flooding
  • Forging email headers or sender information
  • Operating email lists without proper opt-in procedures
  • Harvesting email addresses without consent
  • Chain letters and pyramid schemes

2.4 Content Violations

  • Hosting or distributing pornographic material (unless legally permitted)
  • Defamatory, libelous, or threatening content
  • Hate speech or content promoting violence
  • Content that violates intellectual property rights
  • Impersonation or misrepresentation

2.5 Resource Abuse

  • Excessive bandwidth consumption that impacts other users
  • Running services that violate Fair Use Policy thresholds
  • Cryptocurrency mining on shared infrastructure
  • Operating servers or services not included in your service plan

3. Network Management

3.1 Packet Shaping

Kooluma.com employs packet shaping to manage network traffic and ensure fair access for all users. Protocols subject to shaping include:

  • P2P/BitTorrent traffic
  • NNTP (Usenet) downloads
  • HTTP/HTTPS file hosting downloads
  • Video on Demand (VOD) streaming (on certain plans)

Shaping is applied dynamically based on network congestion and service level. No private user data is retained during this process.

3.2 Fair Use Policy (FUP)

Kooluma.com may invoke Fair Use Policy limits on accounts that exceed usage thresholds. FUP thresholds are displayed on product pages and may include:

  • Total monthly data caps
  • Protocol-specific restrictions
  • Speed throttling during peak hours

Users who grossly abuse the network through improper or excessive use may have their accounts terminated without refund.

4. Security Requirements

  • Users must maintain secure passwords and protect account credentials
  • Users are responsible for all activity on their accounts
  • Compromised accounts must be reported immediately
  • Users must keep their equipment secure and updated
  • Open WiFi networks must be properly secured

5. Reselling Services

Users may not resell or share Kooluma.com services without express written permission. Authorized resellers must:

  • Have access to the Kooluma.com resellers portal
  • Comply with all terms and conditions
  • Ensure their customers comply with this AUP
  • Take responsibility for all activity on resold accounts

6. Monitoring and Enforcement

Kooluma.com reserves the right to monitor network usage to ensure compliance with this AUP. Monitoring may include:

  • Protocol analysis for network management
  • Bandwidth consumption tracking
  • Investigation of abuse complaints
  • Cooperation with law enforcement

Note: Kooluma.com does not monitor the content of user communications except as required by law or to investigate specific abuse complaints.

7. Consequences of Violations

Violations of this AUP may result in:

  • Warning notification
  • Temporary service suspension
  • Permanent service termination without refund
  • Legal action and cooperation with law enforcement
  • Liability for damages caused by violations

The severity of the response will depend on the nature and severity of the violation. Kooluma.com reserves the right to take immediate action for serious violations.

8. Reporting Violations

If you become aware of violations of this AUP, please report them to:

9. Third-Party Networks

When accessing third-party networks through Kooluma.com services, users must comply with the acceptable use policies of those networks, including but not limited to:

  • Internet Solutions
  • MTN
  • Telkom
  • Openserve
  • Other upstream providers

10. User Responsibilities

Users are responsible for:

  • All activity originating from their connection
  • Securing their network and devices
  • Educating household members or employees about this AUP
  • Monitoring usage to ensure compliance
  • Promptly addressing any violations

11. Changes to This Policy

Kooluma.com may update this AUP at any time. Changes will be posted at https://kooluma.com.co.za/legal/aup and become effective immediately. Continued use of services after changes constitutes acceptance of the updated policy.
